Welcome to SHOCAL. These terms and conditions ("Terms") govern your use of our website, mobile applications, and services (together, the "Platform"). By using SHOCAL, you agree to these Terms.

Please read these Terms carefully before using our Platform. If you do not agree to these Terms, you should not use SHOCAL.

1. Introduction

SHOCAL operates a platform that connects customers with local businesses including restaurants, shops, and service providers. We act as an intermediary between you and these businesses ("Partners").

These Terms apply to all users of the Platform, including customers, visitors, and anyone who accesses our services.

2. Using SHOCAL

You must be at least 18 years old to use SHOCAL. By using our Platform, you confirm that you meet this requirement.

When using SHOCAL, you agree to:

  • Provide accurate and complete information
  • Use the Platform only for lawful purposes
  • Not attempt to gain unauthorised access to any part of the Platform
  • Not use the Platform in any way that could damage or impair it
  • Not use automated systems or software to extract data from the Platform
  • Not impersonate any person or entity
  • Comply with all applicable laws and regulations

We reserve the right to refuse service, terminate accounts, or cancel orders at our discretion if we believe you have violated these Terms.

3. Your account

To place orders on SHOCAL, you need to create an account. You are responsible for maintaining the security of your account.

  • Notify us immediately if you suspect unauthorised access
  • You are responsible for all activity on your account

  • Update your information if it changes

We reserve the right to suspend or terminate accounts that violate these Terms or contain false information.

4. Orders and payments

When you place an order through SHOCAL, you are making an offer to purchase goods or services from our Partners.

Placing Orders

  • All orders are subject to acceptance by the Partner
  • Prices are set by our Partners and may change without notice
  • We display prices including VAT where applicable
  • Delivery fees and service charges will be clearly shown before checkout

Payment

  • Payment is taken at the time of ordering
  • We accept major credit and debit cards via Stripe
  • Apple Pay and Google Pay are available on supported devices
  • All payments are processed securely

Order Confirmation

You will receive an email confirmation when your order is accepted. A contract is formed between you and the Partner when the order is accepted.

If a Partner is unable to fulfil your order, we will notify you and arrange a full refund.

5. Delivery

Delivery times shown on the Platform are estimates only. We work with our Partners to ensure timely delivery but cannot guarantee specific times.

Delivery Terms

  • Delivery is available within specified areas only
  • You must provide accurate delivery details
  • Someone must be available to receive the delivery
  • We may contact you if there are issues with delivery

Collection

Where available, you may choose to collect your order directly from the Partner. Collection times are estimates and you will be notified when your order is ready.

Delivery Issues

If you experience any issues with your delivery, please contact us immediately through the app or website. We will work with you and the Partner to resolve any problems.

6. Cancellations and refunds

We understand that sometimes you may need to cancel an order. Our cancellation policy depends on the status of your order.

Cancellation by You

  • You may cancel an order before it is accepted by the Partner for a full refund
  • Once accepted, cancellation may not be possible or may incur charges
  • Contact us as soon as possible if you need to cancel

Cancellation by Partner

Partners may occasionally need to cancel orders due to availability or operational issues. In such cases, you will receive a full refund.

Refunds

  • Refunds are processed to the original payment method
  • Refund processing times depend on your bank (typically 3-5 business days)
  • For quality issues, please contact us with details and we will investigate

Complaints

If you are unhappy with your order, please contact us within 24 hours. We take all complaints seriously and will work to resolve them fairly.

7. User content

You may be able to post reviews, comments, photos, and other content on our Platform. You are responsible for any content you submit.

Content Standards

When posting content, you must not:

  • Post false, misleading, or defamatory content
  • Include obscene, offensive, or discriminatory material
  • Infringe any third party's intellectual property rights
  • Include personal information about others without consent
  • Post spam, advertising, or promotional material
  • Include malicious code or links to harmful websites

Licence

By posting content on SHOCAL, you grant us a non-exclusive, royalty-free, worldwide licence to use, display, reproduce, and distribute that content in connection with our services.

Moderation

We reserve the right to remove any content that violates these Terms or that we consider inappropriate, without prior notice.

8. Intellectual property

All content on the SHOCAL Platform, including text, graphics, logos, and software, is owned by us or our licensors and is protected by intellectual property laws.

Our Rights

  • The SHOCAL name, logo, and branding are our trademarks
  • The Platform design, features, and functionality are our property
  • You may not copy, modify, or distribute our content without permission

Your Use

We grant you a limited, non-exclusive, non-transferable licence to access and use the Platform for personal, non-commercial purposes only.

You may not:

  • Use our content for commercial purposes
  • Modify or create derivative works from our content
  • Remove any copyright or proprietary notices
  • Use our trademarks without written permission

9. Liability

We provide our Platform on an "as is" basis. While we strive to ensure everything runs smoothly, we cannot guarantee uninterrupted or error-free service.

Our Role

SHOCAL acts as an intermediary between you and our Partners. We are not responsible for:

  • The quality, safety, or legality of goods or services provided by Partners
  • The accuracy of Partner information or menu descriptions
  • The actions or omissions of Partners or delivery personnel

Limitation of Liability

To the maximum extent permitted by law:

  • We exclude all implied warranties and conditions
  • We are not liable for indirect, incidental, or consequential damages
  • Our total liability is limited to the amount you paid for the relevant order

Your Rights

Nothing in these Terms affects your statutory rights as a consumer, including rights under the Consumer Rights Act 2015.

10. Termination

You may stop using SHOCAL at any time. We may also suspend or terminate your access to the Platform in certain circumstances.

Termination by You

You can delete your account at any time through your account settings or by contacting us. Upon deletion:

  • Your account will be deactivated
  • You will lose access to order history and saved information
  • Outstanding orders will be completed as normal

Termination by Us

We may suspend or terminate your account if:

  • You breach these Terms
  • We suspect fraudulent or illegal activity
  • We are required to do so by law
  • We discontinue the Platform (with reasonable notice)

Effect of Termination

Sections of these Terms that should survive termination will continue to apply, including intellectual property, liability, and dispute resolution provisions.

11. General

These Terms contain additional provisions that govern our relationship and how disputes are resolved.

Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by email or through the Platform. Continued use after changes constitutes acceptance.

Governing Law

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the English courts.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect.

Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and SHOCAL.

No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
